Privacy Notice

Arc-IT Business Solutions Limited are committed to respecting your privacy and recognise the need to appropriately protect and manage any personal data relating to you. We strive to comply to all applicable laws that are designed to protect your fundamental rights to privacy. From 25 May 2018, our data processing activities will be principally governed by the EU General Data Protection Regulation – 2016/679 (GDPR).

We are the ‘Data Controller’ of the personal data, because we determine the purpose and means of processing by us or our sub-contractors, who would be our ‘Data Processors’. If we process your personal data then you are a ‘Data Subject’. The ‘personal data’ is any information that can be directly or indirectly associated with you by reference to an identifier, such as your name, e-mail address, IP address. ‘Special category data’ includes personal data revealing your racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and genetic data, biometric data, health data, sex life, and sexual orientation.

This notice describes the processing that we perform and the enforceable promise that we make to protect and manage this data. It also describes your rights as a data subject, including the right to complain to a supervisory authority.

How we use your information

We will only process your personal data where we have a legal basis for doing so.

When you contact us by telephone, e-mail, instant messenger, or voice-over-IP, we will collect your personal data and process it for ‘legitimate interests’ in order to fulfil your requirements or interests.

Where we provide managed services to you, we may collect usage and diagnostic information about those assets that we manage. The processing of such data will be necessary for the performance of the contract between us, and we will only use this data for this purpose.

If we speak to you via voice-over-IP we may record these conversations for training purposes.

The use of Cookies

Cookies are a small piece of data sent from a website and stored on your computer by your browser. They are designed to remember information between pages or to record your browsing activity.

Our website www.arcitbusinesssolutions.com uses cookies to improve your browsing experience and to allow us to better serve your needs. We also use Google Analytics to track utilisation, but this holds no personal data.

Who we share your data with

We will not share your information with any third parties for the purposes of direct marketing.

We use selected data processors to provide elements of the services that we may provide to you, and in some cases, this may provide these data processors with access to your personal data.

However, where this occurs the data processors will be contractually obligated to only use the personal data as we have instructed, and not to share your personal information with any other organisation.

Transfers of data outside of Europe

We will not transfer your data outside of the European Economic area, nor will we allow our 3rd party data processors to do so, without providing adequate safeguards.

For how long do we keep your data

We will keep your personal data for 6 years after the last transaction with you. For example, if we have supplied products or services to you, or to the business that you represent, then we will delete your personal data 6 years after the last payment is received. Similarly, if you have been employed by us, we will delete your personal data 6 years after you leave our employment, or after the settlement of any disciplinary or grievance action.

Children’s information

We do not provide services directly to children or proactively collect their personal information.

Data Subject Rights

You have the following rights regarding your personal data that we process. To exercise any of your rights please contact the Data Protection Officer at dataprivacy@aibs.co.uk If you are not happy with how we process your personal data, or dissatisfied with how we have fulfilled your rights, then you have the right to complain to a Supervisory Authority. In the UK this is the Information Commissioner’s Office (ICO) https://ico.org.uk/.

The right to access

You have the right to request a Subject Access Request, allowing you to see the personal data that we process about you, and to satisfy yourself that we are processing your data lawfully.

The right to rectification

You have the right to have your personal data corrected, where you believe the data to be inaccurate or incomplete.

The right to erasure

You have the right to request your data that we process is deleted. This applies when the data is no longer necessary for the purpose for which it was collected, where the processing was unlawful, where the data has to be erased according to a legal obligation, or where you have withdrawn consent or earlier objected to the processing and there are no overriding legitimate grounds.

The right to restrict processing

You have the right to request that we restrict the processing of your personal data to only storage, where the accuracy or lawfulness of the data is being contested, or where the data is no longer necessary for the purpose for which it was collected, or you have objected to the processing.

The right to object

Where we use Legitimate Interest as the lawful basis for processing your personal data, we will have balanced your interests against our own, but you have the right to object to such processing.

The right to data portability

If you want us to pass on your personal data to another controller then we will provide your data in a format that assists you in making this transfer.

The right to withdraw consent

Where processing is based on consent, you will have the right to withdraw your consent at any time.

Automated decision making and profiling

We do not use automated decision making or profiling, but if we consider introducing such technologies in the future, we will inform you in advance of using such technologies and obtain any necessary consent.

Changes to this Privacy Notice

We keep our Privacy Notice under regular review. Any changes to this privacy notice will be posted on our website. We will also attempt to inform you directly by e-mail, where we hold your e-mail address, and when the changes are deemed significant
